PREAMBLE

SEIKO WATCH EUROPE, a simplified joint-stock company with capital of 6,000,000 euros, whose registered office is located at 27-29 rue des Poissonniers 92200 Neuilly-sur-Seine France, registered with the Trade and Companies Register under SIREN number 402759047 (hereinafter referred to as the "Company") specialises in the business sector of wholesale trade (intercompany trade) of watchmaking and jewellery items for the SEIKO brand (hereinafter the "items"). 

In order to better meet the expectations of its customers, the Company has, in parallel with its distribution network, implemented a system for distance selling on the Internet of SEIKO, GRAND SEIKO and CREDOR items on the site identified by the domain name www.seikoboutique.eu, hereinafter the “website”.

Orders placed on the website are reserved for end consumers for strictly personal use, excluding any resale. Items purchased on the Website may under no circumstances be resold in new condition via first-hand distribution channels.

ARTICLE 1: SCOPE

These general terms and conditions are applicable to all sales of items concluded remotely by website via the Company's SEIKO WATCH EUROPE service for delivery in Metropolitan France, Corsica or Monaco. Thus, these general conditions of sale apply:

to orders by customers, natural persons, acting as consumers (within the meaning of the law and case law) and with habitual residence in metropolitan France, Corsica or Monaco.

with a view to delivery to the same customers, natural persons, to themselves or to any third party of their choice who also have habitual residence in mainland France, Corsica or Monaco and who are consumers (within the meaning of the law and case law). The delivery address may be different from the billing address.

Confirmation of the order by the customer implies acceptance without restriction or reservation of these general terms and conditions. These may be subject to modifications and updates, the conditions applicable to the order of an item by a customer are those in force on the day of the order.

ARTICLE 3: ITEM INFORMATION AND LIMITATION OF LIABILITY

SEIKO WATCH EUROPE does its utmost to provide users with accessible and accurate information and/or tools, but cannot be held responsible for errors, lack of availability of information and/or the presence of viruses that could infect the user's computer or any other hardware following the use of or access to the site or any downloads from the site.

Consequently, users acknowledge that use of this information is at their sole risk.

Information (name, definition, reproduction of items, detailed description: properties, characteristics and composition, etc.) relating to all the items offered for sale is available (in accordance with applicable legal and regulatory requirements) on the website.

While the Company takes the utmost care to ensure that the information, descriptions of items and information available on the website are accurate and updated regularly, it cannot be held responsible for any non-substantial errors that may occur.

Likewise, although the photographs and other reproductions of the items represent them faithfully on the website – and this, within the limits of the technology used and in compliance with the best standards of the Internet –, these are however only indicative and have no contractual value. In any event, in the event of non-compliance of the item delivered with its description, the Company undertakes to correct this error, subject to the conditions of article 12 below.

ARTICLE 4: CONDITIONS FOR ORDERING ITEMS

To place an order on the website, the customer must be of legal age, have their habitual residence in metropolitan France, Corsica or Monaco, have legal capacity and hold a bank card as defined in article 8 below and have a valid email address.

In order to place an order, the customer must create an account on the website by completing a form, certain fields of which are mandatory for the order to be processed.

Orders will be received in French and will be accepted within the limits of available stock.

If, despite the best efforts of the Company, the items ordered are no longer available, the Company will inform the customer by any means (telephone call or e-mail) as soon as possible and will refund any price paid via the payment method used when placing the order and at the latest within 30 days. The Company cannot under any circumstances be held responsible for a shortage of stock or the unavailability of items.

The customer agrees that all the information provided to the Company on the website as part of the order complies with these general terms and conditions, is complete, accurate and up-to-date. Failing this, the Company reserves the right to purely and simply cancel the order as well as the payment.

In accordance with the provisions of Article L.122-1 of the French Consumer Code, the Company shall be entitled to refuse any unusual retail sale order.

The Company will also be entitled to refuse any order:

  • (i) made by a customer with whom there is a dispute relating to the payment of a previous order;
  • or
  • (ii) that is not in accordance with these general terms and conditions.
  • or
  • (iii) that is intrinsically flawed due to a computer bug, or any other reason beyond its control, which would distort any information relating to the products (description, price, name, etc.).

If the Company finds that the order does not comply with these general terms and conditions (for example: incorrect delivery address, exceeding the order threshold), it will inform the customer within a maximum period of six (6) days by telephone or by e-mail.

If the customer fails to then correct such erroneous information or elements of the order that are non-compliant with these general terms and conditions, the Company reserves the right to purely and simply cancel the order as well as the payment.

Ordering on the website is subject to strict compliance with the procedures described below, also shown on a succession of different screens displaying the steps customers must follow to confirm their order.

The Customer acknowledges having had communication, prior to placing his order, in a readable and understandable manner, of these General Terms and Conditions and of all the information and guidance referred to in Articles L111-1 to L111-7, and in particular:

  • the essential characteristics of the Product, taking into account the communication medium used and the Product concerned;
  • the price of the Products and related costs (delivery, for example);
  • in the absence of immediate fulfilment of the contract, the date or the deadline on which the Seller undertakes to deliver the Product;
  • information relating to the identity of the Seller, their postal, telephone and electronic contact details, and their business, if these are not evident from the context,
  • information relating to legal and contractual guarantees and how to apply them;
  • the functionalities of the digital content and, where applicable, its interoperability;
  • the option of using conventional mediation in the event of a dispute;
  • information relating to the right of withdrawal (existence, conditions, deadline, ways of exercising this right and standard withdrawal form), the costs of returning the Products, how to cancel other important contractual conditions.

Should a natural person (or legal entity) place an order on the website www.seikoboutique.eu this implies full acceptance and compliance with these General Terms and Conditions, which are expressly acknowledged by the Customer, who waives the right to rely on any contradictory document which would be unenforceable against the Seller.

FIRST STEP: ITEM SELECTION BY THE CUSTOMER

On the website, the customer selects, enters and confirms the name and quantity of the items they wishe to order (the availability of which is to be confirmed by the Company); these items are added to the "BASKET".

SECOND STEP: CONFIRMATION OF THE ITEMS SELECTED

Before definitively submitting the order and confirming their acceptance of this order, the customer has the option of checking the order details and its total price and of amending the order, in particular by deleting a previously selected item, adding an item or changing the quantities ordered in the "BASKET".

The price of the items, as defined in article 6 below, is displayed automatically in the "BASKET".

THIRD STEP: IDENTIFICATION, CONFIRMATION OF THE ITEMS SELECTED AND SUBMISSION OF THE ORDER

Once the customer has completed their selection and wishes to confirm the "Order summary", they must then identify themselves:

  • if they already have a customer account with the Company, by their e-mail address (username) and password;
  • if they do not have a customer account with the Company, they must create one by completing the registration form in the “Create your account” and “Login” section of the website.

The customer must also confirm:

  • the delivery address of the order. The delivery address may be the usual place of residence in France, Corsica or Monaco of a third party beneficiary chosen by the customer or, failing that, the address of the company where the third party beneficiary carries out their professional activity, provided that this is located in metropolitan France, Corsica or Monaco and that this third party is a consumer.

FOURTH STEP: DELIVERY METHOD

HOME DELIVERY AND PICK-UP POINTS

The goods will be delivered to the customer by the delivery company DPD. The customer has the choice between delivery by DPD or delivery to a pick-up point in the DPD Pickup network. The customer will be notified by SMS and/or email when their order is dispatched. They will be emailed a tracking link allowing them to track the delivery of their package. The delivery time is 48h to 72h (working days) once the order has been received and confirmed by SEIKO WATCH EUROPE (non-contractual time for information only).

The customer must present an identity document to the delivery driver to receive their package. If there is no-one to receive the package, the delivery driver will leave a note for the customer with the contact details allowing the customer to contact the delivery company DPD, for a second delivery.

CLICK & COLLECT

Delivery zoneClick & Collect, available with no minimum spend, offers the possibility to pick up an order placed on the Internet in any of the SEIKO WATCH EUROPE boutiques chosen from the list.

As soon as the order is received, our teams will contact the customer to confirm the availability of the product within a maximum of 24 hours from Monday to Friday and 48 hours for an order placed at the weekend.

 If the product is not available in the boutique, SEIKO WATCH EUROPE will refund the customer via the payment method used to place the order on the seikoboutique.fr website.

CollectionThe customer can make an appointment to collect the order from a selected boutique on the seikoboutique.fr website.

 All you have to do is present yourself at the boutique with your order number and proof of identity.

 If the documents are not presented or do not correspond to the information provided with the order, SEIKO WATCH EUROPE reserves the right to cancel the sale.

 The Customer must arrive on the chosen day and within the selected time slot.

 If the delivery of the goods to the Customer is not possible or was not possible due to the Customer's own fault, the Customer will be contacted by telephone to agree on a new delivery time.

Right of withdrawalPlease refer to article 11 "Right of withdrawal and returns" of SEIKO WATCH EUROPE's GTC.

With Click & Collect, the Customer may return the item to the shop where the order was collected in accordance with article 11 of SEIKO WATCH EUROPE GTC, unless the item has been resized.

EXPRESS DELIVERY

Delivery zoneDelivery in Paris and the Parisian suburbs (91/92/93/94/95/77/78) from Monday to Friday for all orders placed between 11 a.m. and 4 p.m. subject to product availability in store. Service free of charge for all orders over €700. Service charged at €15 for all orders under €700.

As soon as the order is received, our teams will contact the customer to confirm the availability of the product within a maximum of 3 hours from Monday to Friday between 11a.m. and 4p.m.. If the product is not available in the boutique, SEIKO WATCH EUROPE will refund the customer via the payment method used to place the order on the seikoboutique.fr website.

Delivery

The goods will be delivered to the customer by the express delivery company Excel Courses.  

The customer can agree a time slot to receive their package delivered to their home address. The delivery address is the address provided by the customer when ordering on the seikoboutique.fr website. The customer agrees to be present at their home at the selected time. On receipt of the package, the customer must present an identity document to the delivery driver to receive their package. If the delivery of the goods to the customer is not possible or was not possible due to the customer's own fault, the customer will be contacted by telephone to agree on a new delivery time or free pick up in store.

 The customer will be responsible for any costs incurred for a second delivery at a cost of €15.

Right of withdrawal

Please refer to article 11 "Right of withdrawal and returns" of SEIKO WATCH EUROPE's GTC.

For express delivery, the Customer may, in accordance with article 11 of the SEIKO WATCH EUROPE GTC, return the item to the Seiko Bonaparte boutique located at 46 rue Bonaparte Paris 6th.

FIFTH STEP: PAYMENT

Payment is to be made either by debit or credit card or by Paypal.

The customer must enter their bank card number according to the conditions of article 7 below.

The customer then clicks the "CONFIRM" button to debit their bank account.

Authorisation from the customer's bank to debit their bank account is displayed. It is recommended that the customer saves and/or prints this debit authorisation.

On authorisation of the debit from the bank account, "the order" is directly transmitted to the Company's order preparation service.

Payment in instalments free of charge with Alma

How does it work?

Choose Alma at checkout. You can pay in 2 or 3 instalments

Simply enter your bank details as you would normally do.

Your order is confirmed right away.

You will then receive an email with the payment schedule and then a reminder 3 days before each due date.

This type of payment is available for all orders between €500 and €4500

Cards accepted are Visa, Mastercard and Amex cards issued in France.

Prepaid, virtual and automatic authorisation cards are not accepted.

Right of withdrawal

Please refer to article 11 "Right of withdrawal and returns" of SEIKO WATCH EUROPE's GTC.

If paying in 2 or 3 instalments free of charge, the Customer may, in accordance with article 11 of the SEIKO WATCH EUROPE GTC, exercise their right of withdrawal without having to provide a reason, within a period of fourteen (14) days from receipt of the items.

Finance is granted subject to acceptance by ALMA SAS - 176 avenue Charles de Gaulle 92200 Neuilly-sur-Seine - registered with the Nanterre Trade and Companies register under number 839 100 575. You have from a distance selling legal withdrawal period.

SIXTH STEP: ACKNOWLEDGMENT OF ORDER AND CONFIRMATION BY THE COMPANY

Within a maximum period of six (6) days following the payment confirmation, the Company shall acknowledges receipt of the order in an e-mail sent to the e-mail address provided by the customer. The sale will only be considered as definite after the Company has sent an acknowledgement of receipt of the order.

In accordance with the provisions of article 1369-2 of the French Civil Code, the customer formally accepts the use of email for the Company to confirm the content of the order.

This confirmation e-mail contains all the information provided by the customer including the method of payment chosen and delivery, the delivery address and billing address. It states the items ordered, as well as the quantities and prices. Plus the order number assigned to the customer by the Company.

ARTICLE 5: PROOF OF ORDER

In general, there is an express agreement between the Company and the customer that e-mails will prevail between the parties as well as the automatic registration systems used by the Customer Relations Department or on the website, in particular with regard to the nature and date of the order.

In addition, the Company keeps the information relating to any order for a period of 10 years and shall make the same available to the customer on simple request sent by the latter to:

However, it is recommended that the customer also keep a copy (in electronic format and/or on paper) of the information relating to their order (for example, the e-mail sent by the Company).

ARTICLE 6: ITEM PRICES

The prices displayed on the website are shown in Euros and include all taxes. The prices billed are those in force on the date the order is confirmed.

For any purchase, the transport costs relating to the delivery of the items ordered on the website are borne by the Company and will not be billed to the customers.

ARTICLE 7: PAYMENT TERMS

Customers must pay for their purchases by bank card. Bank cards accepted are cards bearing the "CB" mark: Visa and Mastercard as well as American Express cards.

In this context, the customer agrees to make payment via a bank card which they personally hold and bearing their identity (surname and first name).

When paying online on the website, customers access a secure server using the 3D Secure security protocol. By providing their bank card number, card expiry date and CVV on the back of his card on the website, customers accept unconditionally in advance that the Company may proceed with the secure transaction. The customer therefore authorises their bank in advance to debit their account in line with the records or statements transmitted by the Company, even in the absence of the cardholder's signature.

Authorisation to debit a customer's account is always given for the amount of the item(s) purchased as invoiced by the Company.

The customer's bank card is debited within a maximum of seven (7) days after customer confirmation of the payment on the website (i.e.: following the customer clicking the "CONFIRM" button on the page of the website relating to bank details or over the telephone) and after verification of the compliance of the order with these general terms and conditions and the availability of the item(s).

In the event that, for any reason whatsoever (objection, refusal of the issuing bank, etc.), the sums owed by the customer cannot be debited, the order will not be accepted by the Company.

ARTICLE 8: DELIVERY

Products purchased on the website can only be delivered in mainland France, Corsica and Monaco.

The Company is responsible for the choice of carrier for all purchases made on the website.

Delivery is free of charge for orders over €50 including VAT.

Delivery costs €6 inc. VAT for all orders under €50 inc. VAT.

Scheduled home delivery costs €6 inc. VAT for all orders under €700 inc. VAT.

Express delivery costs €15 for all orders under €700 inc. VAT.

Delivery to a Pick-up point costs €6 inc. VAT for any order under €50 inc. VAT.

Items will be shipped to the delivery address provided during the checkout process.

It is agreed that the articles can only be delivered:

  • to the customer's primary place of residence, which must be in mainland France, Corsica or Monaco;
  • to the delivery address indicated by the customer when placing the order, bearing in mind that the stated address must correspond to the primary place of residence of a third party beneficiary chosen by the customer and who primarily resides in mainland France, Corsica or Monaco or, failing that, to the address of the company where he/she works, provided that this is located in mainland France, Corsica or Monaco;
  • to a UPS Pick-up point, selected by the customer;
  • in any case, delivery cannot be made to hotels or a PO box address.

In this regard, the customer agrees to provide the exact delivery address and any other additional information (telephone number and mobile phone number) when confirming the order, so that the goods can be delivered correctly.

The Company will not be held responsible if the delivery address given when the order was placed is incorrect or incomplete.

 Delivery will be subject to receiving the customer's signature.

 The customer must present proof of identity to receive the goods.

The items will be delivered after the order amount has been paid, more specifically, after the customer's bank account or Paypal account has been debited and the funds corresponding to the order total have been credited to the account of SEIKO WATCH EUROPE.

 The customer can enjoy standard delivery by UPS within an average of 2 (two) to 3 (three) working days in mainland France, Corsica and Monaco, starting from the working day after the email confirming that the carrier has taken charge of the package (non-contractual duration for information purposes only).

In accordance with the provisions of article L.138-1 and subsequent articles of the Consumer Code, the delivery of the ordered articles will occur:

  • either within 30 days, at the latest, following payment confirmation of the order on the website, subject to full payment of the price.
  • or, in the event of the article being temporarily unavailable, within the timeframe previously notified to the customer by email or telephone and agreed to by the customer.

If the package appears to be damaged upon delivery, the customer must open it in the presence of the carrier in order to inspect the condition of the item, notify the carrier of any concerns, specifically on the delivery slip, confirm these concerns by registered letter within 3 days following the delivery of the package and inform the Company by email to [email protected]. Non-compliance with the procedure or acceptance of the order as it stands excludes all claims against Seiko.

The Seller agrees to do its best to deliver the products ordered by the Customer within the timeframes specified above.

 These times are given as an indication.

However, if the Products ordered have not been delivered within 30 days following the estimated delivery date, for any reason other than force majeure or the fault of the Customer, the sale may be cancelled at the written request of the Customer under the conditions set out in Articles L 138-2 and L 138-3 of the Consumer Code.

 Any sum paid by the Customer will then be returned within fourteen days at the latest following the cancellation of the contract, excluding any compensation or deductions.

ARTICLE 9: RETENTION OF OWNERSHIP

The Company retains ownership of the items ordered and delivered until full payment of their price in principal and interest, that is to say until full and effective receipt of the payment price by the Company.

In the event of non-payment in full or in part, the Company may, without prior notice, reclaim the item(s) which may have been delivered by the Company to the customer.

The customer assumes all risks concerning the items delivered (in particular loss, theft or deterioration) from the effective delivery date.

ARTICLE 10: INTELLECTUAL PROPERTY RIGHTS

The website is the exclusive property of the Company, which has created and published online the web pages, the images and source scripts, and the underlying data. Customers are therefore prohibited from distributing or reproducing the site, in whole or in part, in any form whatsoever.

The Company's products, as well as all trademarks, graphic or not, and, more generally, all other brandings, illustrations, images, designs and models and logos appearing on the Company's items sold at a distance, their accessories or their packaging, whether registered or not, are and will remain the exclusive property of the Company. Any total or partial reproduction, downloading, modification or use of these trademarks, illustrations, images and logos, designs and models for any reason and on any medium whatsoever, without the express prior written consent of the Company, is strictly prohibited. The same applies to any combination or conjunction with any other brand, symbol, logotype and more generally any distinctive sign intended to form a composite logo. Any act of counterfeiting and any complicity will be prosecuted.

Likewise, the following are strictly prohibited, without the express prior written consent of the Company:

  • the creation of hypertext links to any of the pages or any of thE elements making up the website;
  • the use of any of the elements composing it (items shown, descriptions, prices, data, software, graphics, images, texts, photographs, tools, etc.) for sale or any other direct or indirect commercial use.

ARTICLE 11: RIGHT OF WITHDRAWAL AND RETURNS

In accordance with the provisions of articles L.121-17 et seq of the French Consumer Code, the customer has a right of withdrawal which they can exercise, without having to provide a reason, within a period of fourteen (14) clear days from receipt of the items. They have the option of returning the items delivered within this period, in their original packaging, in perfect condition, complete (accessories, instructions, guarantee, case, cushion, protective films, etc.) and accompanied by a copy of the invoice and the withdrawal form, to the address shown on this form.

The Company reserves the right to refuse the return if these conditions are not met.

The customer must complete the online  " Return form" in order to submit a withdrawal request and to organise the return of the goods with SEIKO WATCH EUROPE. Once agreed, a returns label, pre-paid by the Company, will be sent to the customer. The items must be returned according to the instructions provided by the Company.

The customer must ensure that the products are properly packaged so that they do not suffer any damage during transport.

It will be up to the customer to retain any proof of this return.

"Personalised" items are neither exchangeable nor refundable.

Refunds will be made via the payment method used (credit card or Paypal) when the order was placed, within fourteen days from the day the Company receives the returned product(s).

The credit note will be sent to the customer by email in the form of a "discount code". This discount code can be used in full or in part for a period of one year by placing a classic order on the Seiko Boutique Officielle France website. In order to activate the discount code, the customer will have to connect to the customer account via which he/she placed the order. 

Returned items that are incomplete, spoiled, damaged, broken or soiled by the customer will not be refunded in full.

Click & Collect customers will not be able to return their order if the product has been resized. 

ARTICLE 12: CONFORMITY – WARRANTY

The customer must ensure that the items delivered correspond to the order placed.

In the event that the items delivered do not conform to the order, the customer must, within a maximum period of 15 days from receipt of the package, complete the "Return form" in order to submit a return request. Once agreed, a returns label, pre-paid by the Company, will be sent to the customer.

Retured items must be in their original packaging, in perfect condition, complete (accessories, instructions, guarantee, cases, cushions, protective films, etc.) and accompanied by a copy of the invoice and the Return/Exchange form, to the address shown on this form.

The items must be returned according to the instructions provided by the Company, the costs of return being borne by the Company.

The customer must ensure that the products are properly packaged so that they do not suffer any damage during transport.

The Company reserves the right to refuse the return if these conditions are not met.

If it is not possible to exchange the returned items, the price paid for the non-conforming items that have been returned will be refunded by crediting the account of the payment method used (bank card or Paypal) when the order was placed on the website, at the latest within thirty days of receipt by the Company of the returned items.

Returned items that are incomplete, spoiled, damaged, broken or soiled by the customer will not be refunded in full.

ARTICLE 13: WARRANTY

The duration of the commercial warranty offered by the seller is 2 years from the date of purchase for SEIKO, GRAND SEIKO and CREDOR watches from the seikoboutique.fr site.

We only offer warranties for products purchased on the website www.seikoboutique.fr, for all other products, please contact your nearest retailer.

To claim under the warranty, please contact our customer service department on 01 81 93 48 53 to submit a request. Depending on the circumstances, a return form will be sent to you by e-mail as well as a postage label, the cost of which is covered by SEIKO WATCH EUROPE. The warranty card received with your product as well as the copy of the purchase invoice from the site must be included in the package. Once we receive the product under warranty, our repair department will check it and repair or exchange it.

If the repair is not covered under the warranty, please contact our customer service first on 01 81 93 48 53 for a preliminary diagnosis. Depending on the circumstances, a return form will be sent to you by e-mail. Shipping costs will be your responsibility. The warranty card received with your product, the copy of the purchase invoice on the site (downloadable from the site in the section "MY ACCOUNT / HISTORY AND DETAILS OF MY ORDERS") as well as the repair form must be enclosed and sent to:

We will send you a quote before we take any action. If you do not accept the quote, the product will be returned to you and the return costs will be at your expense. The shipment will be sent cash on delivery. If you do not wish your product to be returned, SEIKO WATCH EUROPE will destroy it in accordance with current legislation. If you do accept the quote, after it has been replaced or repaired, the product will be sent cash-on-delivery at your expense.

This warranty covers the case, movement, dial, hands and any metal strap, it does not cover the glass, the battery, straps made of any material other than metal, and scratches caused by normal use. Likewise, damage caused by natural disasters, such as earthquakes and floods, is not covered. If the watch is marked “WATER RESISTANT” on the back of its case, this warranty covers damage caused by water infiltration.Please refer to the instruction booklet to know the product's level of water resistance or intended use, or check below:

-       3-bar water resistance: If the words "WATER RESISTANT" appear on the back of the case, the watch has been designed and manufactured to withstand up to 3 bars, such as accidental contact with water, splashing or rain, but it is not suitable for swimming or diving.

-       5-bar water resistance: If the words “WATER RESISTANT 5 BAR” are written on the back of the case, your watch is designed and manufactured to withstand up to 5 bars and is suitable for swimming, sailing and showering.

-       10-bar water resistance: If the words "WATER RESISTANT 10 BAR", "WATER RESISTANT 15 BAR" or "WATER RESISTANT 20 BAR" are written on the back of the case, your watch is designed and manufactured to withstand up to 10/15/20 bar and is suitable for bathing and shallow diving, but not for scuba diving. For this type of diving, we recommend using the professional SEIKO diver's watch from the "DIVER'S WATCH" series, "DIVER'S 200M" to "DIVER'S 1000M" diver's watch.

If during the warranty period the item has been tampered with and damaged by anyone other than an official SEIKO agent, this warranty will not apply.

Independently of the warranty thus granted, the Company remains liable for defects in the conformity of the goods with the contract and for redhibitory defects under the conditions provided for in Articles 1641 to 1649 of the French Civil Code.

Article 1641 of the French Civil Code: The seller is bound by the guarantee in respect of hidden defects of the item sold which make it unfit for the use for which it is intended, or which reduce such use so much that the buyer would not have acquired the same, or would have paid only a lesser price, had they been aware of them.

Article 1648 of the French Civil Code: Action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.

Article L211-4 of the French Consumer Code: The seller is required to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery.

He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation where this was their responsibility under the contract or was carried out under their responsibility.

Article L211-5 of the French Consumer Code: To comply with the contract, the goods must:

1. Be suitable for the use usually expected of a similar item and, where applicable:

  • correspond to the description given by the seller and possess the qualities that the latter has presented to the buyer in the form of a sample or model;
  • present the qualities that a buyer can reasonably expect given the statements made by the seller, manufacturer or their representative, in particular in terms of advertising or labelling;

2. Or present the characteristics mutually agreed between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.

Article L211-12 of the French Consumer Code: Action resulting from a lack of conformity is time limited to two years from delivery of the goods.

ARTICLE 14: PERSONAL DATA

The Company is required to process the personal data of its customers in connection with sales made through the website. The data collected is necessary to process orders and may be disclosed to the Company's service providers involved in the fulfilment of the order.

ARTICLE 15: VALIDITY OF THE GENERAL TERMS AND CONDITIONS

The performance by the Company of all or part of its obligations will be suspended in the event of the occurrence of a fortuitous event or force majeure which would hinder or delay its performance.

The following are considered as such in particular, without this list being exhaustive: war, riots, insurrection, social unrest, telephone or computer breakdowns or serious impairment of the security and coherence of the Internet network, strikes of any kind.

The Company will inform the customer of such a fortuitous event or force majeure within seven days of its occurrence. In the event that such suspension of the performance of the Company's obligations continues beyond a period of fifteen days, the customer will then have the option of cancelling the order in progress, and will then be refunded by the Company as soon as possible by a credit to the customer's bank account or Paypal account.

Should the Company refrain at any time from demanding the fulfilment of any of the provisions of these general terms and conditions, this shall not be construed as a waiver of the right to raise such total or partial non-fulfilment at a later date.

ARTICLE 16: DISPUTES - APPLICABLE LAW

If any of the provisions of these general terms and conditions is declared invalid in whole or in part, the other provisions and the other rights and obligations arising from these general terms and conditions will remain unchanged and will remain applicable.

These Terms and Conditions are governed and interpreted in accordance with French law without taking into account the principles of conflict of laws.

The competent court will be the French court with local jurisdiction under French law.

SEIKO WATCH EUROPE reserves the right to seek and obtain injunctions or orders in defence of its rights hereunder.

ALL DISPUTES THAT MAY ARISE FROM THE PURCHASE AND SALE TRANSACTIONS UNDERTAKEN IN APPLICATION OF THESE GENERAL TERMS AND CONDITIONS, CONCERNING THEIR VALIDITY, INTERPRETATION, PERFORMANCE, TERMINATION, CONSEQUENCES AND EFFECTS, AND WHICH CANNOT BE RESOLVED BETWEEN THE SELLER AND THE CUSTOMER, SHALL BE BROUGHT BEFORE THE COMPETENT COURT IN ACCORDANCE WITH THE LAW.

Customers are informed that they can in any case resort to conventional mediation, in particular with the Consumer Mediation Commission ( Consumer code art. L 534-7) or with existing sector-based mediation bodies, or any alternative dispute resolution method (conciliation, for example) in the event of a dispute.

If no amicable agreement can be reached, the consumer may refer the matter free of charge to the consumer ombudsman to which the trader belongs, namely the Association of European Mediators (AME CONSO), within one year of the written complaint to the professional.

Referral to the consumer ombudsman must be made:

ARTICLE 17: REPAIR REQUEST

Seiko allows you to have your watch diagnosed by our watchmakers by sending it to our official Seiko repair centre or by making an appointment at one of our official SEIKO WATCH EUROPE stores.

QUOTE

If a customer's watch is out of warranty, a quote will be sent before any action is taken.

For watches under warranty, certain faults or interventions are not covered. In this case a quote will be provided.

If there is no response to our quote after approximately one month, we will return the watch to you unrepaired.

Any quote that is refused or not responded to will be charged at 15 euros excluding taxes, or 18 euros including tax. This price includes the cost of troubleshooting and the cost of shipping.

If when carrying out the work we notice more damage than when the quote was created, a new quote may be proposed.

PRICE

The customer can consult the price list at any time (link to the explanation to identify the technology with the calibre and the relevant table).

This price only includes labour. Spare parts such as a strap, case, glass, dial, etc. are extra.

Waterproofing with replacement seals is included in the prices that include opening the watch (excluding work on the strap).

SHIPPING

Under warranty:

Shipping costs are free for watches under official Seiko international warranty.

A pre-paid label will be sent to the customer once the repair request has been validated by our teams.

If the customer's watch is under warranty, they must enclose the original  correctly completed international warranty card and/or the dated purchase invoice allowing the watch to be identified (the international warranty is valid for 2 years from the date of purchase for watches purchased in the European Union, Norway, Switzerland and Andorra. It is only valid for one year when purchased in another country.).

Out of warranty:

If a customer's watch is no longer under warranty, a quote will be sent before any action is taken. For watches out of warranty, shipping costs will be borne by the customer.

Seiko undertakes to check the condition of the watches on arrival at its premises. Any damage resulting from transportation will not be covered by Seiko and will be subject to a quote.

REPAIR

Repairs are guaranteed for 1 year only for the work that was carried out. Any new fault, different or unrelated to the previous one, will be subject to a new invoice after quotation.

This service does not cover battery changes for watches under warranty or out of warranty. For this type of work, customers may contact an authorised Seiko retailer.

Some watches may be returned unrepaired due to unavailability of parts, even if a quote has been drawn up.

REPAIR TIME

The usual repair time is 2 to 3 weeks, however if a spare part is not available, this time may be longer. A letter will then be sent to the customer to provide an estimated timescale. This timescale may be subject to change based on the manufacturer's information.

Some specific watches are only repaired in Japan. In this case the timescale is approximately 2 months, or even longer in the event of a shortage of certain spare parts.

RETURN

The watch will be returned to the delivery address provided during the repair request.

In this regard, the customer agrees to provide the exact return address and any other additional information (telephone number and mobile phone number) when requesting the repair, so that the watch can be delivered correctly.

The Company will not be held responsible if the delivery address given when the repair request was submitted is incorrect or incomplete. Delivery will be subject to receiving the customer's signature.

 The customer must present proof of identity to receive the goods.

It is understood that the watch can only be returned to the customer's place of residence, which must be in mainland France, Corsica or Monaco.

If the package appears to be damaged on return, the customer must open it in the presence of the carrier in order to inspect the condition of the watch, notify the carrier of any concerns, specifically on the delivery slip, confirm these concerns by registered letter within 3 days following the delivery of the package and inform SEIKO WATCH EUROPE by email to [email protected].

Delivery is carried out by the carrier DPD. In the event that the customer is not present, the latter must have provided Seiko with an e-mail address and a telephone number (mobile or landline).

ARTICLE 18: SEIKO WATCH EUROPE E-GIFT CARD

E-GIFT CARD: refers to a prepaid account on the merchant's online site. Each e-gift card has a unique code.

ALL SEIKO e-gift cards are the property of the issuing company, SEIKO WATCH EUROPE, a simplified joint stock company, with capital of 6,000,000 euros, whose registered office is located at 27-29 rue des Poissonniers, 92200 Neuilly-sur-Seine, France, registered with the NANTERRE Trade and Companies Register under number B 402 759 047. 

The e-gift cards are valid exclusively in France for the purchase of products for sale on our site. www.seikoboutique.fr.

The price of the e-gift card can be paid by bank card or via Paypal. The price of the e-gift card cannot be paid via Alma or by another e-gift card.

An e-gift card can only be cancelled by the buyer and only if it has never been used. To do this, the buyer must submit a request via the "Contact us" page of the website and within 14 days of the purchase date of the e-gift card. Any request received after this 14-day period cannot be honoured.

In the event of cancellation, the buyer will be refunded, free of charge and via the payment method previously used, for the total amount of the e-gift card.

An e-gift card cannot be resold, transferred in return for a consideration or exchanged for cash.

An e-gift card can be used as often as its holder wishes during its period of validity, until its total amount is spent.

E-gift cards cannot be used on Click&Collect orders (in-store pick up).

The balance available on the e-gift card is the difference between the amount available before a purchase and the amount used to make that purchase. When the purchase price exceeds the available balance of the e-gift card, the difference can be paid by any other means of payment accepted on our site. www.seikoboutique.fr.

Products purchased on our site www.seikoboutique.fr using an e-gift card are subject to the general terms and conditions in the same way as all other products purchased on our online store.Amounts spent on an e-gift card can only be refunded by issuing a new e-gift card.

An e-gift card is valid for a period of one year from its date of issue on our site www.seikoboutique.fr and the e-gift card being sent to the recipient. On expiry of the validity period, the e-card cannot be renewed or used for purchases, and any available balance on the e-gift card cannot be accessed.

E-gift cards are not assigned to a specific name. The holder will be exclusively responsible for the use and safekeeping of the e-gift card. It cannot be replaced in the event of theft, loss or damage.
