4. General Information
4.1. Contracts concluded through the Online Store are entered into in Polish.
4.2. The prices displayed on the Store’s website, as well as the Product descriptions, constitute commercial information and do not constitute an offer within the meaning of the Civil Code. They become binding—for the purposes of concluding a specific Sales Agreement—only upon the Seller’s confirmation of acceptance of the Order for fulfillment.
4.3. The Customer’s acceptance of these General Terms and Conditions is a prerequisite for making a purchase in the SEIKO Online Store.
5. Order Placement Process
5.1. The Customer may view selected Products by clicking on the Product name or image, which allows them to add selected items to the Shopping Cart using the [Add to Cart] button. This action does not constitute an obligation to make a purchase.
5.2. To finalize the purchase, the Customer must proceed to the next step by clicking the [Checkout] button. At this stage, the Customer has the option to create a Customer Account or continue the process as a guest. If an Account is created, the Customer may log in to their account to identify themselves beforehand.
5.3. If the option to place an Order as a guest is selected—i.e., without registration—the Customer places the Order by entering the recipient’s details and the delivery address for the Product, and is then required to select the shipping method (how the Product will be delivered), click the “Order and Pay” button and confirm the order by clicking the link sent in the email.
5.4. The next step is to select the preferred payment method from the available options, including, but not limited to: SEPA direct debit, credit card, PayPal, or another available method indicated on the website.
5.5. The Customer has the right to modify or delete the information contained in the Shopping Cart, including details regarding the selected Products, at any time before placing the final Order.
5.6. The final submission of the Order is made by clicking the [Order with obligation to pay] button, which is equivalent to the Customer submitting a binding offer to enter into a contract for the Products in the Shopping Cart. This completes the Order placement process.
5.7. After placing the Order, the Customer will receive an automatic email confirming that the Order has been accepted for processing. This message does not yet constitute confirmation of the conclusion of the contract.
5.8. The sales contract is concluded upon fulfillment of the conditions specified for the payment method selected by the Customer.
6. Payment Methods
6.1. The SEIKO Store offers the following payment options:
SEPA Direct Debit:
If you choose to pay via SEPA Direct Debit by entering and confirming your bank details during the ordering process, the price of the ordered Product will be debited from your bank account. You will be notified of this via email at least one day before the direct debit is processed. The sales contract is concluded upon confirmation of the Product’s shipment.
Credit Card
By submitting a binding Order, the Customer provides their credit card information. Once the verification process confirming the Customer as the cardholder is complete, the credit card company will initiate the payment transaction. At this point, the Sales Agreement is concluded.
PayPal
As part of the ordering process, the Customer will be redirected to the website of the online payment service provider PayPal. On this page, the Customer must enter payment details and confirm the payment instructions for PayPal. After placing an Order in the Store, PayPal will initiate the payment transaction. At that moment, the Sales Agreement is concluded.
Purchase on Account
In the case of a purchase on account, SEIKO’s claim for payment against the Customer is transferred to PayPal PLUS. To pay the purchase price, the Customer is required to make a payment to PayPal PLUS. SEIKO remains responsible for general customer inquiries (e.g., regarding goods, delivery times, shipping, etc.), complaints, notices of withdrawal from the contract, and returns. The payment term is fourteen days from receipt of the goods. The sales contract is concluded upon confirmation of shipment of the goods.
To process the payment, the data necessary for processing the payment transaction—i.e., the Customer’s first and last name, street address, house number, ZIP code, city, phone number, and the payment details provided—as well as order-related data will be transferred to PayPal PLUS. For more information about PayPal PLUS’s privacy policy, please refer to their privacy policy at the following link: (How do I manage my personal information and privacy settings in my PayPal account? | PayPal PL)
6.2. Since there is no obligation to issue structured invoices for sales via the KSeF (National e-Invoice System) to a purchaser of goods or services who is a natural person not engaged in business activity, SEIKO issues an invoice in electronic or paper form. The invoice will be attached in PDF format to the shipping confirmation sent via email after the Customer has made a purchase.
The Customer agrees to receive the invoice in electronic form.
6.3. Ownership of the ordered Product is transferred to the Customer upon payment of the price, in accordance with the provisions above. Until the price is paid, ownership of the goods remains with the Seller. The risk of loss or damage to the goods passes to the Buyer upon payment of the full price and delivery of the goods, including handover to the courier company.
7. Delivery Terms and Timing
7.1. Delivery costs are borne by the Seller. Delivery is provided free of charge by the shipping service provider GLS to the address specified by the Customer when placing the order. The Seller reserves the right to change the courier company, even after the contract with the Buyer has been concluded.
7.2. Delivery time within Poland is 3 to 5 business days. If delivery of the goods within the aforementioned timeframe is not possible, the Customer will be immediately notified by the Seller. Likewise, if the product is no longer available, the Customer will be immediately notified and any payments made will be refunded.
7.3. Upon handing over the Product to the courier company, the Buyer will be notified of this fact via an SMS message sent to the phone number or email address provided in the Order. From that moment on, the Customer will receive automatic emails from GLS informing them of the shipment’s status.
8. Prices
8.1. The prices of Products listed on the Store’s website include statutory VAT.
8.2. By placing a binding Order and providing a Tax Identification Number (NIP), the Consumer declares that they are not required to account for intra-Community acquisitions of goods in Poland, as referred to in Article 9 of the VAT Act. Consequently, the sale of goods by Seiko Germany, Branch of Seiko Watch Europe to the Customer is subject to VAT in Poland in accordance with Article 22(1)(1a) in conjunction with Article 2(22a) of the VAT Act.
9. Warranty
9.1. The Seller shall deliver new Products that comply with the Sales Agreement and are free from defects.
9.2. In the event of defects, in particular non-conformity of the Products with the Agreement, the Seller shall be liable to the Customers under the warranty for defects in goods, as regulated by the Act of April 23, 1964—the Civil Code.
9.3. The Seller is liable under the warranty for physical or legal defects in the sold Products only if such defects are discovered within two years of the Product being delivered to the Customer. The moment of delivery is the moment the Customer receives the Product.
9.4. The Seller shall not be liable for the Product’s non-conformity with the Agreement if the Customer, at the latest at the time of concluding the Sales Agreement, was expressly informed that a specific characteristic of the Product deviates from the requirements of conformity with the Agreement, and expressly and separately accepted the absence of that specific characteristic of the Product.
9.5. A complaint must be submitted in writing or electronically to the Seller’s addresses provided in these Terms and Conditions or using the electronic complaint form made available by the Seller on the Store’s website.
The complaint must include a concise description of the defect, the circumstances (including the date) of its occurrence, the details of the Customer filing the complaint, and the Customer’s request regarding the Product defect.
9.6. The Seller shall respond to a complaint within 14 days; if the Seller fails to do so within this period, the Customer’s complaint shall be deemed valid.
9.7. Notwithstanding the foregoing, the Products are covered by the manufacturer’s warranty. The warranty terms and conditions are available on the Online Store’s website and are also provided in writing with each ordered Product.
9.8. Any additional warranties granted do not affect the Customer’s statutory rights.
